Aranland Limited ("the Company", "we", "us", or "our") operates the AranOne platform (the "Platform"). We are committed to protecting your privacy and ensuring the security of your personal data in accordance with the Kenya Data Protection Act, 2019.
This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Platform for real estate transaction tracking, handover support, and property services.
1. DATA CONTROLLER AND CONSENT
1.1 Data Controller: For the purposes of providing a digitized platform and managing your property transaction information, account details, and service history, Aranland Limited acts as a Data Controller.
1.2 User Consent: By clicking the invitation link and activating your account, you explicitly state: "I agree to AranOne processing my transaction information as a Data Controller to facilitate the digital management of my property purchase and related services."
1.3 Basis of Control: Our status as a Data Controller is established through specific data sharing and processing agreements between Aranland Limited and the respective Real Estate Developer from whom you purchased your property. These agreements authorize Aranland Limited to determine the purposes and means of processing data within the Platform to provide enhanced digital services.
2. INFORMATION WE COLLECT
As a Data Controller, we collect and process the following categories of personal data:
Identity Data: Name, National ID/Passport number, and gender (verified against developer records).
Contact Data: Email address, phone number, and physical mailing address.
Transaction & Financial Data: Unit number, project name, purchase price, payment milestones, and financial status related to the transaction.
Technical Data: IP address, login credentials, browser type, and device information.
Interaction Data: Digital inspection records, handover logs, maintenance requests, and communication history within the Platform.
3. HOW WE COLLECT DATA
Integrated Migration: Your initial transaction details are migrated to our Platform from the Developer's records upon your expression of consent to the developer to proceed with the property purchase, pursuant to the contractual arrangements mentioned in Section 1.3.
Direct Interaction: Information you input directly when updating your profile or using handover/maintenance tools.
Automated Tracking: Usage data collected through secure system logs and functional cookies.
4. PURPOSES OF PROCESSING
We process your data to:
Provide a centralized Transaction Tracking dashboard for your property purchase.
Facilitate the Handover Support system, including digital defect reporting and appointment scheduling.
Provide an integrated Property Services portal for post-delivery requests.
Ensure Platform security and prevent fraudulent access.
Meet statutory reporting and compliance requirements under the Laws of Kenya.
5. DATA SHARING AND DISCLOSURE
We may share your information with:
The Developer: To synchronize transaction milestones and handover results.
Authorized Service Providers: Contractors or property managers assigned to resolve issues reported by you.
Regulatory Bodies: When required by the Office of the Data Protection Commissioner (ODPC) or other Kenyan legal authorities.
We do not sell your personal data to third parties for marketing purposes.
6. DATA SECURITY AND STORAGE
6.1 Protection: We employ industry-standard encryption and multi-factor authentication to protect your transaction data.
6.2 Localization and Cross-Border Transfers: Your data is stored on secure servers located in the European Union (specifically the Netherlands and/or Ireland).
6.3 Safeguards: To ensure compliance with the Kenya Data Protection Act, 2019 and the General Data Protection Regulation (GDPR), we have entered into Data Processing Agreements (DPA) with our database and cloud service providers. These agreements incorporate standard contractual clauses and appropriate technical measures to ensure that your personal data receives an adequate level of protection during cross-border transfers.
7. YOUR RIGHTS UNDER KENYAN LAW
Pursuant to the Kenya Data Protection Act, 2019, you have the right to:
Access: Request a copy of the transaction data we hold.
Correction: Update inaccurate or incomplete information.
Objection: Object to processing based on legitimate interests.
Erasure: Request deletion of your data, subject to legal retention periods (e.g., tax or land transfer laws).
Withdrawal of Consent: Withdraw your consent for processing at any time, which may result in the termination of your access to Platform features.
8. DATA RETENTION
We retain your transaction information for the duration of your relationship with the project and for a subsequent period as required by Kenyan limitation statutes and financial record-keeping laws.
9. COOKIES
The Platform uses functional cookies to maintain your session. You may restrict cookies via browser settings, but this may impair Platform performance.
10. CHANGES TO THIS POLICY
We reserve the right to update this policy. We will notify you of any significant changes via the Platform interface or your registered email.
